TERMS OF SERVICE

1. Service Description

TheFindGuy (“we,” “us,” “our”) is a research and location service operated by LXB Studio LLC. We provide information location services using publicly available information, online research, and legal investigative methods. We are NOT licensed private investigators and do not provide surveillance, legal investigation, or any services requiring licensure.

2. Acceptable Use

You agree to use our services only for lawful purposes. You may NOT use our services for:

  • Stalking, harassment, or intimidation
  • Any illegal purpose or activity
  • Locating individuals who have restraining orders against you
  • Locating minors without proper legal authority
  • Identity theft or fraud
  • Any purpose that violates local, state, or federal law

3. Service Limitations

We make no guarantees about successful location of persons or items. Our services are limited to:

  • Publicly available information
  • Legal research methods
  • Information accessible without special licensure
  • Non-deceptive inquiry methods

4. Payment Terms

  • 50% deposit required to begin work
  • Balance due upon successful completion
  • 30% research fee for unsuccessful searches
  • No refunds for services terminated due to illegal/unethical requests
  • Travel expenses billed separately for IRL/Full packages

5. Right to Refuse Service

We reserve the absolute right to refuse or terminate any service request at our sole discretion, particularly if we believe the request may be used for harmful, illegal, or unethical purposes.

6. Client Representations

By engaging our services, you represent and warrant that:

  • You are at least 18 years of age
  • Your request is for lawful purposes only
  • You will not use information obtained for harassment or illegal activities
  • All information provided to us is accurate
  • You have the legal right to request the information sought

PRIVACY POLICY

Information We Collect

We collect information you provide directly to us, including:

  • Name and contact information
  • Payment information (processed securely through third-party providers)
  • Details about your search request
  • Communications between you and our service

How We Use Your Information

We use collected information to:

  • Provide our services
  • Process payments
  • Communicate about your request
  • Comply with legal obligations
  • Protect against fraudulent or illegal activity

Information Sharing

We do NOT sell, rent, or trade your personal information. We may share information only:

  • With your explicit consent
  • To comply with legal obligations
  • To protect our rights or safety
  • With service providers who assist in our operations (under confidentiality agreements)

Data Retention

We retain client information for 3 years for legal and tax purposes. Search results and reports are retained for 1 year unless earlier deletion is requested.

Your Rights

You have the right to:

  • Access your personal information
  • Request correction of inaccurate information
  • Request deletion of your information (subject to legal requirements)
  • Opt-out of marketing communications

Security

We implement reasonable security measures to protect your information. However, no method of transmission over the Internet is 100% secure.

LEGAL DISCLAIMERS

Not a Licensed Private Investigator

IMPORTANT: TheFindGuy and its operators are NOT licensed private investigators. We do not perform any services that require PI licensure, including but not limited to: surveillance, background checks for employment, legal investigations, or process serving.

Information Accuracy

While we strive for accuracy, we make NO WARRANTIES regarding the accuracy, completeness, or timeliness of information found. All information should be independently verified before taking any action based upon it.

Nothing in our services or communications constitutes legal advice. For legal matters, consult a licensed attorney.

Public Information Only

We use only publicly available information and legal research methods. We do not hack, use pretexting, or engage in any deceptive practices.

No Guarantee of Success

We cannot guarantee successful location of any person or item. Some searches may be unsuccessful despite our best efforts.

Third-Party Information

Information obtained from third-party sources is provided “as is” without warranty. We are not responsible for the accuracy of third-party data.

LIMITATION OF LIABILITY & INDEMNIFICATION

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THEFINDGUY, LXB STUDIO LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or use
  • Business interruption
  • Emotional distress
  • Any damages resulting from use or inability to use our services
  • Any damages resulting from information obtained through our services
  • Actions taken based on information we provide

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICE PROVIDED.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless TheFindGuy, LXB Studio LLC, and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney’s fees) arising from:

  • Your use of our services
  • Your violation of these terms
  • Your violation of any law or third-party rights
  • Any claim that your use of our services caused damage to a third party
  • Your misuse of information obtained through our services

ASSUMPTION OF RISK

You acknowledge and agree that:

  • Use of our services is at your own risk
  • Information provided may be incomplete or inaccurate
  • You are responsible for verifying all information independently
  • You are responsible for the legal and ethical use of information obtained

ADDITIONAL TERMS

Governing Law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Lancaster County, Pennsylvania.

Arbitration Agreement

Any dispute arising from these terms or our services shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except for claims in small claims court.

Severability

If any provision of these terms is found unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These terms constitute the entire agreement between you and TheFindGuy/LXB Studio LLC regarding our services.

Modifications

We reserve the right to modify these terms at any time. Continued use of our services constitutes acceptance of modified terms.
